License Agreement

1.1. al-Farabi Kazakh National University (hereinafter referred to as the University) offers the Institutional Repository of KazNU (hereinafter referred to as the Repository) to the Licensee under the terms set forth in this International Agreement (hereinafter referred to as the Agreement). The Agreement shall enter into force upon the Licensee's acceptance of its terms in the manner specified in clause 1.4.

1.2. The University offers a license to access the Repository for the purpose of depositing (self-archiving) storage objects. All services of the University related to the Repository are set forth in this Agreement.

1.3. The functions of using the Repository are regulated by the proposals for the institutional repository of information resources of KazNU named after al-Farabi, posted on the website of the al-Farabi Library (https://elibrary.kaznu.kz/en) and this Agreement.

1.4. Depending on the function the Repository uses for depositing (self-archiving) storage objects and/or proceeding with the registration stage, the Licensor deems that by accepting the terms of this Agreement, the Licensee fully and unconditionally accepts them without reservations and exceptions. In the event of the Licensee's disagreement with the provisions of this Agreement, they shall not have the right to use the Repository.

1.5. Regardless of which function of the Repository is used to host (self-archiving) storage of objects and/or go through the registration stage, the Licensor believes that by accepting the terms of this Agreement, the Licensee accepts them fully and unconditionally.

2.1. The Licensor must undergo temporary registration and create a high-quality account in order to access all the functions of the Repository for depositing (self-archiving) storage objects.

2.2. When registering, the License Agreement provides only accurate and complete information about oneself on the issues proposed in the registration form and updates this information as necessary.

2.3. The personal data of the Licensor contained in their account are stored and processed by the University in accordance with the legislation of the Republic of Kazakhstan on the processing of personal data.

2.4. When registering, the Licensor independently chooses a unique symbolic name for their account and a password to access it. The University ensures compliance with its requirements for the account and password.

2.5. The Licensor independently ensures the confidentiality of their account and is responsible for all actions and their consequences when using the functions of the Repository under their account. This includes cases of transmitting the Licensor's account data to a third party.

2.6. All actions when using the Repository with the Licensee's account are performed by the Licensee themselves, except in cases where the Licensor has notified the University of unauthorized access to their account in accordance with clause 2.7. of this Agreement.

2.7. The Licensor is obliged to notify the University of any unauthorized access to the functions of the Repository using User accounts and/or any breach of the confidentiality of their accounts.

2.8. The license is not entitled to reproduce, copy, sell, or use any materials for any commercial purposes in the field of intellectual property rights on storage objects.

3.1. The Licensor is solely responsible for its actions related to the use of the Repository functionality, including if such actions result in the infringement of the rights and legitimate interests of third parties, as well as for compliance with the legislation when using the Repository.

3.2. The Licensor has the right to:

3.2.1. add documents under their account through self-archiving and/or with the help of the main administrator;

3.2.2. save their profile;

3.2.3. exercise other rights in accordance with this Agreement.

3.3. When using the Repository, the Licensor must not:

3.3.1. upload, post, and/or distribute documents and materials that are illegal, competitive, defamatory, promote and achieve cruelty, hatred, or discrimination against people based on race, ethnicity, gender, religion, social change, with strict adherence to any physical or legal laws, contain elements or promote pornography, child erotica, advertise goods and services, explain the procedures for manufacturing, using, or otherwise utilizing narcotics and psychotropic substances or their precursors, explosive substances, or other weapons;

3.3.2. upload, post, and/or distribute scientific works without the rights to do so in accordance with the current legislation of the Republic of Kazakhstan and/or international treaties of the Republic of Kazakhstan;

3.3.3. consider actions aimed at violating the restrictions and prohibitions imposed by this Agreement.

3.4. The Licensee has the right to terminate this Agreement if it determines that at the time of conclusion the Licensor did not possess legal rights to the Works.

4.1. The agreement may be amended by the University without any official notification. The new version of the Agreement comes into effect from the moment of its publication on the Repository website.

4.2. Matters not regulated in this Agreement are gradually resolved in accordance with the requirements of the legislation of the Republic of Kazakhstan.

4.3. Disputes and disagreements arising from the relationships existing in this Agreement are resolved through negotiations between the Parties. In the event that the Parties do not reach an agreement, the dispute is resolved in the manner established by the legislation of the Republic of Kazakhstan.

4.4. Due to the gratuitous nature of the services provided under this Agreement, consumer protection norms provided for by the obligations of the Republic of Kazakhstan cannot be applicable to the relationship between the Licensor and the Repository.

4.5. No provision of this Agreement shall be construed as establishing agency relations, joint activity relations, or any other relations not explicitly provided for in this Agreement between the Licensor and the Repository.

4.6. Other actions of the University in the event of the Licensor's violation of any other compliance with the provisions of this agreement do not deprive the Repository of the right to consider such actions in defense of its interests in the future, nor does it imply the Repository's waiver of its rights in the event of any subsequent deviation.

4.7. This Agreement is drawn up in Kazakh, Russian, and English languages, and all versions are authentic. In the event of any discrepancies between versions in different languages, the provisions of the Kazakh/Russian/English version of this Agreement shall apply.
